Premises Liability

Our firm represents injured people who get hurt due to a dangerous condition on someone else's property.

Trip and Fall Claims

The most common type of case in this area is a trip and fall case. For example, we represented a client who was walking down a city sidewalk on her way to a church service. She tripped on a defective portion of the sidewalk, fell, and broke her wrist. We were able to successfully settle her case for her, after we proved that the property owner and the local town had responsibilities to keep the sidewalks safe for pedestrians, and they both failed to do so in this case.

We understand how frustrating it can be for injured victims to try to deal with these cases on their own. Several times we have had clients tell us that the insurance adjuster told them there was only $1,000 or $5,000 in available coverage. In fact, that may actually be the amount of 'Med Pay' coverage, which is available to an injured person regardless of who is at fault. There is also usually a liability policy, which will only pay out when we can show that the property owner was negligent in some way.

Personal Injury Cases

If you suffer a significant injury in a slip and fall, or trip and fall, case, we do advise that you consult with an experienced attorney early in the case. It is very common that an insurance adjuster may interview you about what happened and try to talk you into admitting that the accident was mostly your own fault. If you make this admission in Montana, you may undermine your case due to comparative negligence.

Wherever you are in Southwest Montana: Dillon, Deer Lodge, Anaconda, Philipsburg, Drummond, Butte, or any of the surrounding area, you need an experienced premises liability attorney like Mike Grayson working on your injury claim.

Legal Counsel on Contingency

Most cases are handled on a contingency fee basis. Our fee is a percentage of the settlement, and we only get paid if we obtain a settlement for you, which means that you can have strong, competent legal representation even if you cannot afford to pay a retainer fee.
